As a reputable operator I have $2 million of liability insurance, just in case, and you should always check operators are properly insured.

At the start of each session I explain the rules and emphasise the main risk involved, which in my experience is being hit with a tagger in the excitement.

The insurance company insists that there are inherent risks and dangers that may cause serious injury and death, but in 13 years of operation the most serious injuries sustained have been the usual bumps, cuts and scrapes you pick up playing anything outdoors. No deaths or heart attacks so far! It's also worth noting that in BC it's illegal to sign away a child's rights to sue, so the waiver is actually worthless, but informed consent is important.

Regardless, I'm supposed to get signed waivers from everyone, so on the right is an email form that confirms you've read the following, and on the left are links to the paper version, in Microsoft Word, Apache OpenOfficeand as a Pdf.

RELEASE OF LIABILITY, WAIVE OF CLAIMS,

ASSUMPTION OF RISK AND INDEMNITY AGREEMENT.

 

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

 

Assumption of risk:

1. I, the undersigned, wish to to take part in a combat simulation game. I recognise and understand that playing involves certain risks which include, but are not limited to, injury resulting from equipment malfunction and tripping or falling in the playing area. I also recognise that the exertion of playing the game could result in injury or death.

2. Despite these and other risks, and fully understanding such risks, I wish to participate and assume said risks. I also hereby hold harmless the organisers and indemnify them against any and all claims, actions, suits, procedures, costs, expenses (including legal expenses), damages and liabilities arising out of, connected with, or resulting from my participation, including without limitation, those resulting from the manufacture, selection, delivery, possession, use or operation of the equipment. I hereby release the organisers from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, representatives and assigns.

3. I hereby certify that I am in good health and do not suffer from a heart condition or other ailment which could be exacerbated by the exertion of playing, and I further certify that I am 19 years of age or older.

 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

 

In consideration of participating in the games, I hereby agree as follows:

1. To waive any and all claims that I have or may have in the future against North Island Battlefield, their directors, officers, employees, agents and representatives (collectively referred to as the “Releasees”);

2. To release the releasees from any and all liability for any loss, damage, injury or expense that I or my next of kin may suffer as a result of my participation due to any cause whatsoever , including negligence on the part of the releasees;

3. To hold harmless and indemnify the releasees from any and all liability for any damage to property of, or injury to, any third party, resulting from my participation;

4. I grant to the organisers the absolute and irrevocable right and unrestricted permission concerning any photographs that are taken of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including, promotion, art, editorial, advertising, and trade, without restriction as to alteration. I release and discharge the organisers from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorisation and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of the photographer, as well as the person(s) for whom he/she took the photographs.

 

I have read and understood this agreement, and I am aware that by signing it I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators and assigns may have against the releasees.
